Balochistan High Court (BHC), on Tuesday, nullified President Arif Alvi’s notification regarding 10th National Finance Commission (NFC).
BHC bench who headed by chief justice Jamal Khan Mandokhel heard the case along with judge Nazeer Ahmed Lango and nullified the appointment of Finance Adviser Abdul Hafeez Shaikh and the federal finance secretary as members of the NFC, declaring it unconstitutional in light of Article 160 of the Constitution of Pakistan.
Furthermore, citing Article 160 of the Constitution, the court directed federal and provincial secretaries to assist their respected ministries in the matter and remarked that NFC member should have an in-depth understanding of the economic problems of the province and be well versed in economic matters.
In addition to it, the court also warned the federal government that according to Article 160, province’s share in NFC award cannot be reduced.
It is to be noted that Kamran Murtaza Advocate, Sajid Tareen Advocate and Muhammad Aslam Bhootani – an independent MNA from Gwadar-Lasbela, had earlier filed a petition in BHC against the NFC notification issued by President Office.
